2) Eligibility: The State Farm® “Fly Away” Sweepstakes (the “Promotion”) is open to legal residents of the fifty (50) United States & the District of Columbia & Canadian provinces of Alberta, New Brunswick & Ontario (excluding residents of Quebec) who are of legal age of majority in their jurisdictions of residence (and at least eighteen (18) years of age), except employees, officers, directors, representatives, independent contractor agents and the agents’ staff members of State Farm Mutual Automobile Insurance Company (hereafter, “Sponsor”), ipsh!, Project Support Team, Inc. (“P/S/T”) & each of their respective parent companies, subsidiaries, affiliates, retailers, distributors, suppliers, & advertising & promotion agencies (collectively, “Released Parties”), & the immediate families (spouse, parent, child, sibling & their respective spouses) of any of the foregoing regardless of where they reside (as well as those domiciled with them, whether or not related). 3) Three Ways to Participate: Between 12:00PM Pacific Time (“PT”) on 5/18/09 & 11:59PM PT on 7/14/09 (the “Promotion Period”), you may enter in the following ways: 1) Online: Visit www.SFMusicTour.com/www.SFMusicTour.ca & fully complete & submit the online entry form according to the provided instructions. By successfully transmitting your completed online entry form as directed, you will be entered in the Promotion. 2) Survey: Visit the State Farm booth located at select No Doubt Concerts (for a list of concerts, please visit www.SFMusicTour.com/www.SFMusicTour.ca) during regular operating hours and complete the 3-6 question survey by the specified deadline to be entered in the Promotion. 3) Wireless Application Protocol (“WAP”): During the Promotion Period, visit http://sfmusictour.mobi using your WAP enabled wireless device and complete the Official Entry Form to receive one (1) entry in the sweepstakes. NOTE: You may be charged for WAP service according to the terms of your service agreement with your service provider. You must be a wireless service subscriber with a WAP enabled wireless device to enter via this method. Check your phone capabilities for specific WAP instructions. There is a limit of one (1) entry per person/household/email address/wireless number regardless of the method of entry. Multiple entries received from any one person/household/email address/wireless number after the first entry received from that person, household, email address or wireless number will be void. Released Parties are not responsible for lost, late, stolen, incomplete, damaged, garbled, delayed, undelivered, inaccurate, incorrect, or misdirected entries, surveys or transmissions, interrupted or unavailable network, satellite, cable, Internet Service Provider (ISP), server, website or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines or technical failures, errors or difficulties, malfunction of phones, phone lines or telephone systems or other communication malfunctions, errors, difficulties or malfunctions, garbled, jumbled, misrouted, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether mechanical, human, network, electronic, computer, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the announcement of the prizes, the cancellation or postponement of any concert, or the processing of entries; for inaccurate entry or other Promotion related information, printing, typographical or other errors appearing in these Official Rules, or in other promotion related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion. Persons who tamper with or abuse any aspect of the Promotion or website or attempt to undermine the legitimate operation of the Promotion by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Promotion is unlawful and subject to legal action by the Sponsor. By participating, entrants agree to abide by these Official Rules & to the decisions of the Sponsor, which shall be final & binding in all matters relating to this Promotion. Use of script, macro or any other mechanical or automated means device to automate entry is prohibited & any entries received through such means will be disqualified and all associated entries will be void.
4) Four (4) Grand Prizes: A 3 day/2 night trip for winner & three (3) guests to attend a No Doubt Concert at a date and location to be determined by Sponsor. Trip consists of round-trip coach air transportation for four (4) from major gateway airport nearest winner’s primary residence in the U.S. or Canada, (2) night standard double-occupancy hotel accommodations (one (1) room), ground transportation to/from the airport & the applicable hotel & to/from the hotel & the concert, four (4) tickets to a No Doubt Concert, and $1,000 in spending cash (for winner only) to be awarded as a check. Total Approximate Retail Value (“ARV”) of each Grand Prize: $12,000 USD. Actual value of prize may vary depending on winner’s city of departure and final itineraries. Winner is responsible for all federal, state, local and provincial taxes, meals, luggage fees, insurance, gratuities, additional ground transportation (other than that described above) & for any other costs and expenses associated with prize acceptance and use not specifically stated herein as being provided. Trip must be taken on date(s) specified by Sponsor or prize will be forfeited in its entirety &, at Sponsor’s sole discretion, an alternate winner may be selected. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of concert venue, as determined by Sponsor in its sole discretion, & to award no additional compensation or substitution for the difference in prize value. Certain travel & hotel restrictions may apply. Travel arrangements must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Winner & his/her guests are responsible for obtaining any/all necessary documents (including but not limited to valid passports, visas and/or photo I.D.) prior to departure. Tickets to concert are subject to & governed by certain terms and conditions as specified thereon. If the concert is cancelled, no compensation or substitution will be provided in lieu thereof; however, remainder of prize package will be awarded & Sponsor shall have no further obligation to winner. If the concert is postponed, winner’s trip will be re-scheduled for the date on which the concert will take place. Sponsor reserve the right to remove or to deny entry to winner & his/her guest if he/she engage(s) in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the concert. Limit one (1) prize per person, per household and per email address. Total ARV of all prizes to be awarded: $48,000 USD.
5) Drawing: Potential Grand Prize winners will be selected by P/S/T in a random drawing conducted on or about 7/16/09 from among all eligible entries received for the entire Promotion Period. Odds of winning will depend on the number of eligible entries received for the entire Promotion Period. Potential Grand Prize winners will be notified by email, telephone, U.S. mail and/or overnight express and will be required (where legal) to execute and return an Affidavit of Eligibility, Liability and Publicity Release (or, if a resident of Canada, a Declaration) within two (2) days of date of issuance of notification. If any Grand Prize winner’s guest is a minor, a parent or legal guardian, must execute & return a liability/publicity release on behalf of minor guest (where permitted by law) prior to issuance of travel documents. Minor guest(s) (if any) must be accompanied by a parent or legal guardian, & applicable winner & guest must travel on same itinerary.
6) Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion of prize) permitted except by Sponsor who reserves the right to substitute a prize (or applicable portion of prize) with one of comparable or greater value, at its sole discretion. If an eligible Canadian entrant is selected as a potential winner, he/she will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered by telephone at a pre-arranged, mutually convenient time before being declared a winner. If selected Canadian potential winner cannot be reached by telephone within a reasonable time period, as determined by Sponsor, he/she may be disqualified, and, at Sponsor’s discretion, the applicable prize will be awarded to an alternate winner. Failure to satisfy any of the foregoing, comply with these Official Rules, the inability of Sponsor to contact a potential winner within a reasonable time period as described herein or a prize notification being returned as non-deliverable for any reason will result in disqualification, such prize being forfeited &, at Sponsor’s discretion, an alternate winner may be selected from all remaining eligible entries. By entering, entrants agree: 1) that Sponsor & its designees shall have the right & permission to use entrant’s name and/or picture, photograph, image, video, or biographical information or voice and/or other likeness and prize information for trade, advertising, promotional and/or any other purposes in any media or format now known or hereafter devised throughout the world in perpetuity without any further compensation, consideration, permission or notification except where prohibited by law; & 2) that the Released Parties and their designees and assigns shall have no liability & will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel or other activity related thereto and any injury and/or harm resulting from use of any prize) and/or participation in this Promotion. Sponsor reserves the right, in its sole discretion, to void suspect entries and/or modify, terminate or suspend this Promotion (or any portion thereof) should a virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper operation of the Promotion (or any portion thereof). In the event of termination of the Promotion, Sponsor may, at its discretion, select winners from all eligible, non-suspect entries received prior to event requiring such termination. In the event of a dispute as to the identity or eligibility of an online entrant, entrant will be deemed individual named on the online entry form regardless of whether that individual is the authorized account holder of the email address at issue.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH ENTRANT, AND SPONSOR RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
